Notice on Annual Consumption, Import Quantity and Phase-out Rates of Ozone Depleting Substances

WHEREAS, it is expedient to control the annual import and consumption of Ozone-depleting Substances within the Kingdom of Nepal in an effort to gradually forbid and phase out the use of the substances that are likely to have an adverse impact on the environment as provided for in the Vienna Convention for the Protection of the Ozone Layer, 1985 and Montreal Protocol on Substances that Deplete the Ozone Layer, 1987 (Montreal Protocol), to which Nepal is a party, and in order to fulfill the obligations set forth by the Convention, Protocol and United Nations Environment Programme;

NOW, THEREFORE His Majesty's Government has, by exercise of the power conferred by Subsection (3) of Section 7 of the Environment Protection Act, 1996, made the following arrangements:

Annual Consumption and Import Quantity of Ozone-depleting Substances
The annual consumption and import quantity of the following substances, amongst the various Ozone-depleting Substances mentioned in the Annexes A, B, C and E of the Montreal Protocol that are currently being used in Nepal for refrigeration, air-conditioning and in other commercial, industrial and agricultural sectors, and by hospitals, the fire brigade, etc., has been determined as follows:

(A) Montreal Protocol: Controlled Substances

The joint annual import quantity of Trichlorofluoro-methane (CFC - 11) and Dichlorodifluoromethane (CFC - 12) mentioned in this table has been determined in such a way that it shall not exceed 29.058 metric tons for the year consumption quantity of these substances is 29.058 metric tons. 2000, since the current annual joint

(B) Montreal Protocol: Controlled Substances

The annual import quantity of Chlorodifluoro-methane (HCFC- 22) mentioned in this table has been determined in such a way that it shall not exceed 23.04 metric tons for the year 2000, since the current annual consumption quantity of this substance is 23.04 metric tons.

The annual import quantity of other Ozone-depleting Substances used in agriculture, and by hospitals, the fire brigade, etc., such as Halon, Carbon Tetrachloride, Methyl Chloroform and Methyl Bromide as mentioned in this table, shall be two metric tons subject to alterations as prescribed from time to time, since their total consumption quantity for the year 2000 has been two metric tons.

The annual phase out rate of the following ozone-depleting substances has been determined as follows:
A) The joint phase out rate of Trichlorofluoromethane (CFC - 11) and Dichlorodifluoromethane (CFC - 12)

(B) Chlorodifluoromethane (HCFC - 22)
The import and consumption quantity of Chlorodifluoromethane (HCFC - 22) has been determined as 23.04 metric tons per annum up to the year 2015 AD. Thenceforth, this shall be phased out annually and brought down to zero by the year 2040 AD.

(C) The phase out rate of the substance as mentioned in Clause (B) above from the year 2015 AD onwards shall be pursuant to the amendments by the meetings under the Montreal Protocol.

(D) Other Ozone-depleting Substances

As for the phasing out of other Ozone-depleting Substances being currently consumed in Nepal, the same shall be as prescribed by the Ministry of Population and Environment pursuant to the provisions of the Protocol, since the total consumption of these substances is low in quantity.

  • The import of ozone-depleting substances as mentioned in Clauses (A) and (B) of Section 1 above shall be done only under import license issued by the concerned agency of His Majesty's Government as per the recommendation of the Ministry of Population and Environment. The re-export of such substances shall not be allowed.

  • The total quantity of the substances mentioned in Clauses (A) and (B) of Section 1 above that have been imported into the Kingdom of Nepal till the publication of this notice shall be counted for the purposes of determining the quantity of such substances to be imported under license during the year 2000 AD.

  • In the case of any confusion regarding any matter contained in this notice, the Ministry of Population and Environment shall clarify thereupon.

  • The other provisions regarding the regulation of annual import and consumption of the substances mentioned in this notice, and their management, control, monitoring, etc., shall be as prescribed by the prevailing law.
